Los Angeles, March 23 – in letter [1] to the Communications Office of the California Judicial Council, chaired by the California Supreme Court Chief Justice, Ronald George, Dr Joseph Zernik, Los Angeles County resident, requested comments or response by the Communication Office regarding alleged fraud by the Judicial Council, and/or its subordinate offices, related to the false imprisonment of Richard Fine. Following previous communications with the Judicial Council in this matter, Dr Zernik alleged that the most plausible sequence of events related to the imprisonment of Richard Fine included a false and deliberately misleading retainer agreement by the Judicial Council for Attorney Kevin McCormick, who appeared in the habeas corpus petition of Richard Fine on behalf of Judge David Yaffe and the Superior Court of California, County of Los Angeles. Such retainer agreement most likely included a false case caption for the habeas corpus: “Fine v Sheriff of the Los Angeles Court” – a non existent case caption – while listing the correct case number. The correct caption for the case was “Richard Fine v Sheriff of Los Angeles County”. Therefore, the Judicial Council did not hold itself accountable for the conduct of Attorney Kevin McCormick in the case. However, Attorney Kevin McCormick appeared in the case on behalf of Judge David Yaffe and the Superior Court of California, with no authority to do so by the latter two parties. He proceeded to file false records, false declaration, and false brief. All such conduct was aimed to obstruct and pervert justice in the habeas corpus petition of Richard Fine, and to affect Richard Fine’s false imprisonment. Regardless of the false case caption, Dr Zernik stated that most likely, the California Judicial Council still paid Attorney McCormick for his conduct. Therefore, the Council should be held as colluding in the fraud in his appearances and his conduct in the case. The letter concluded: “I would be grateful if you could respond on behalf of the Judicial Council and/or its subordinate offices on the allegations of fraud by the Judicial Council, chaired by Chief Justice Ronald George, relative to its conduct in re: the retainer agreement of Attorney Kevin McCormick, and collusion with Attorney McCormick in affecting the false imprisonment of Richard Fine.”
