Analysis of the fraud in the electronic systems of the courts in Israel is fascinating, since the systems are relatively new, and one can trace, who did what when to corrupt the systems.
In contrast, in the United States, by the time I started the analysis, the systems were already old. However, circumstantial evidence suggests that former Chief Justice of the California Supreme Court Ronald George was central to the implementation of Sustain, the fraudulent electronic record system of the Los Angeles Superior Court. I believe that it was the first of its kind, which was implemented in the United States or the world, around 1984.
The fraudulent Israeli record systems were implemented over the past decade by IBM, EDS, in violation of the law of the State of Israel, according to the 2010 State Ombudsman's Report 60b.

The evidence shows that the case of Moshe
Silman against the Social Security Administration in the Tel-Aviv District
Court was conducted as simulated litigation [Halichim LeMar'it A'in]: The
original complaint was filed under a case number, which now the Tel Aviv District
Court says never existed; Judge Brenner affected dismissal of the original
complaint and also affected the dismissal of an appeal from his own decision,
and the Court insists on producing decisions that are not signed by a judge and
not authenticated by a clerk. Earlier
this year, the Administration of the Courts denied, with no legal foundation,
request for the appointment record of Chief Clerk Kobi Bleich of the Tel-Aviv
District Court. Now the Tel Aviv District Court is asked to order Mr Bleich to
produce his appointment record. The

Tel Aviv, November 19 – In his suicide letter,
the self-immolated social protest activist Moshe Silman leveled serious
accusations against Judge Hagai Brenner and the Tel Aviv District Court. Following the discovery of serious
irregularities in court records, pertaining to Silman, Joseph Zernik, PhD, of Human
Rights Alert (NGO) has filed a request in the Tel-Aviv District Court for the
lawful appointment record of Chief Clerk Kobi Bleich. [1,2,3]
The
request notes that:
· The Tel Aviv
District Court continues to refuse to certify any of the records in the cases,
related to Moshe Silman.
· Review of the
Court's records indicates that the cases related to Silman were/are conducted
as simulated litigation. [4]
· Request for
the appointment record of Chief Clerk Kobi Bleich, pursuant to the Freedom
of Information Act, filed earlier this year with the Administration of
Courts, was denied with no legal foundation. [5]
Today's request in part says:
"… the
following was discovered upon examination of the data in the online public
access system of the Court:
a.
In file 1752-08 – Hagai Brenner, in his hat as Magistrate,
purportedly affected the dismissal of Moshe Silman's original complaint.
b.
In file 6909-01-10 – Hagai Brenner, in his hat as District Judge
pro tem, purportedly dismissed the appeal, which originated from his own
decision in file 1752-08.
c.
In file 1752-08 – purported decisions of the Court, which were
received by the Requester by mail, do not appear in the list of
"Decisions" in the online public access system.
d.
In file 6909-01-10 – purported decision of District Judge Ofra
Cherniak, dated November 4, 2012 – "Decision on Appellant's Request…"
– appears in the list of "Decisions" in the system. This "Decision" was not served on
the Requester to this date.
…
Therefore,
considering the entire body of evidence, described above, a reasonable person
would conclude, or at least be concerned:
a.
Conduct of the office of the Clerk of the Court in these cases is not
within the framework of the law… and related proceedings in the Tel Aviv
District Court, pertaining to Moshe Silman, were and/or are conducted as
simulated cases, and
b. In the Tel Aviv District Court
the Office of the Clerk is managed by a Chief Clerk that was never lawfully
appointed, and is therefore a simulated Chief Clerk.
7. בנוסף, התגלו הממצאים הבאים במהלך בדיקת הנתונים
במערכת המקוונת של בית המשפט בתיקים הנ"ל:
א. בתיק 1752-08 - חגי ברנר, בכובעו כרשם, גרם כביכול למחיקת

לרבות בקשת זירוז הליכים" - מופיעה ברשימת "החלטות בתיק" במערכת.
"החלטה" זאת לא נמסרה למבקש1 עד יום זה. [[iii]]
8. המבקש1 הגיש במרץ
ובאפריל, שנה זאת, בקשות להנהלת בתי המשפט, בכפוף לחוק חופש המידע -1988, לקבלת
העתק של כתב מינויו של מזכיר בית המשפט המחוזי בתל-אביב קובי בלייך. הנהלת בתי המשפט סירבה ומסרבת לענות על בקשה
זאת, ללא כל בסיס בחוק. [[iv]]
9. ממצאים נוספים,
שסוכמו בדו"ח שהגיש המבקש1 למועצת זכויות האדם של האומות המאוחדות, מצביעים
על חוסר התקינות וחוסר האמינות של הכתבים האלקטרוניים בבתי המשפט במדינת ישראל
ומעלים חששות כבדים לגבי תקינות ואמינות המזכירויות בבתי המשפט בישראל. [[v]]
10. לפיכך, בהתחשב בכלל
הממצאים שתוארו לעיל, קרוב לוודאי שאדם בר-דעת יסיק, או לפחות יחשוש:
א. שהתנהלות מזכירות
בית המשפט בנוגע לתיקים הנ"ל, אינה במסגרת החוק, וששלושת התיקים וההליכים
המתאימים, הקשורים למשה סילמן, בבית המשפט המחוזי בתל-אביב - 13491/2008 , 1752-08, ו-6909-01-10
- התנהלו ו/או מתנהלים כתיקים למראית עין
וכהליכים למראית עין.
ב. שבבית המשפט המחוזי
בתל-אביב מתנהלת מזכירות, בה המזכיר הראשי מעולם לא מונה כדין, ולפיכך הוא בבחינת
מזכיר ראשי למראית עין.
11. לטענת המבקש1,
הממצאים שתוארו לעיל, אינם עומדים בקנה אחד עם זכויות האדם למשפט הוגן ופומבי
ולהגנה שווה של החוק.
לפיכך
מבקש החתום מטה:
א.
שכבוד בית המשפט ימציא את החלטתו בעניין בקשה זאת כשהיא
חתומה על ידי רשם או שופט בצירוף מכתב נלווה חתום על ידי אדם בר סמכות חוקית
במזכירות בית המשפט.
ב.
שכבוד בית המשפט ירשום בתיק זה החלטה המורה על מזכיר
בית המשפט קובי בלייך להמציא לצדדים בתיק, ובכללם המבקש1, העתק של כתב מינויו.
The case of Moshe
Silman and the Chief Clerk of the Tel Aviv District Court is not unique
either. In a
recent letter to the Chief Clerk of the Supreme Court of the State of Israel,
invalid electronic records were noted in a petition to compel Governor of the
Bank of Israel Stanley Fischer to perform his duties, relative to banking
regulation. [6] The letter asks for the
appointment record of Chief Clerk Sarah Lifschitz of the Supreme Court. The letter notes that a request for Ms
Lifschitz's appointment record, pursuant to the Freedom of Information Act, was
denied, claiming exemption for "records of internal deliberations".
Ms Lifschitz has been occupying the office of Chief
Clerk of the Supreme Court since 2002.
Human Rights Alert's submission for the 2013
Universal Periodic Review of Human Rights in Israel by the Human Rights Council
of the United Nations, based primarily on data mining research,
documents unprecedented corruption of the electronic records of the Courts of
the State of Israel, starting in 2002 under Presiding Justice Aharon Barak,
including but not limited to numerous decision records, which appear certified
by the late Chief Clerk Shmaryahu Cohen, up to five (5) years after his death. [7]
The Human Rights Alert submission is titled, "Integrity, or lack thereof, of the electronic
record systems of the courts of the State of Israel", and subtitled,
"A court, which refuses to certify its own records, is certified
corrupt".
The Human Rights Alert 2010 submission
to the Human Rights Council, pertaining to the California
courts was incorporated into the 2010 United Nations report on Human Rights in
the United States , with a
note referring to "corruption of the courts and the legal profession… in California
