13-01-08 Michigan Justice to Resign, Why Not Criminally Prosecuted???

The fact that a justice was reuired to resign for real estate fraud in the court is surprising.  In California, real estate fraud by judges has been a common feature of the courts for over a decade.
The Human Rights Alert (NGO) submission to the United Nations focused on two issues:

  • Real estate fraud in the courts
  • Large-scale false imprisonment.
The submission was later incorporated in the offical United Nations report with a note pertaining to "corruption of the courts and the legal profession".

Scandal-Plagued Michigan Justice to Resign in Disgrace

Michigan Supreme Court Justice Diane Hathaway will resign from the Court, an announcement made on the same day that the state Judicial Tenure Commission recommended she be suspended.  In a devastatingcomplaint, the Commission accused Hathaway of committing criminal fraud, bank fraud, money laundering, and tax fraud.  According to the Commission, Hathaway’s real estate dealings constitute:
• “misconduct in office”
• “conduct clearly prejudicial to the administration of justice”
• “irresponsible or improper conduct which erodes public confidence in the judiciary”
• “conduct involving impropriety and the appearance of impropriety”
• “a failure to respect and observe the law”
• “allowing family relationships to influence judicial conduct”
• “utilizing the prestige of office to advance personal business interests”
• “misuse of judicial office for personal advantage or gain”
• “conduct which exposes the legal profession or the courts to obloquy, contempt, censure, or reproach”
• “conduct that violates a criminal law of a state or of the United States”
As I have noted earlier, the “merit” selection crowd has been largely silent about Justice Hathaway’s fraudulent real estate dealings.  Maybe it’s because Hathaway is aligned with their far-left ideological views.  Or maybe it’s because the Hathaway scandal demonstrates that corruption on the court comes in all shapes and sizes that have absolutely nothing to do with judicial elections.  Whatever the reason, the Hathaway scandal is proof positive that Michigan doesn’t need “merit” selection to get rid of judges who abuse their offices for private gain.

Michigan Justice Diane Hathaway Resigns After Agency Accused Her Of “Blatant and Brazen Violations”

HathawayMichigan Supreme Court Justice (and former prosecutor) Diane Hathaway has resigned from the state’s highest court after a judicial agency accused her of “blatant and brazen violations” of judicial ethics that include allegations of bank fraud, tax fraud, money laundering and lying to investigators. The alleged facts are quite shocking and lead to the question of why Hathaway has not been charged criminally. In 2008, Hathaway launched a successful Democratic campaign to unseat conservative Chief Justice of the Court, Cliff Taylor. Her heavily negative campaign accused Taylor of failing asleep on the bench and declared “If you see justice in the name, he really belongs in the hall of shame.”
