Tel
Aviv District Judge Eitan Orenstein – is one of the named suspects
in a criminal complaint, filed with the Israeli Attorney General,
relative to conduct of sham litigation in the case of Moshe Silman.
Judge Orenstein's and attorneys' conduct in the “IDB bankruptcy”
case should deem corruption of the courts and the legal profession a
major risk for the stability of Israeli financial markets.

Tel-Aviv, November 25 – accumulation of news reports, relative to
the “IDB bankruptcy” case, point out that corruption of the
courts and the legal profession should be deemed a major risk factor
for stability of financial markets in Israel:
*
The Marker reports today: “Following The Marker expose': Ohad
Aloni was suspended as counsel for bond-holders in the IDB case.”
Trustees
of the bond holders decided to suspend Attorney Aloni from
representation. Aloni founded an organization of IDB bond-holders,
but operated out of Dankner's office.
*
Globes reports today: “In the margins of the IDB saga: Conflict of
interest by Attorney Ohad Aloni?”
Aloni
founded “The organization for protection of public savings”...
apparently he was recruited for supporting Nochi Dankner...
*
The Marker reports today: “MK Margalit: We are talking about
dismantling pyramids, while building a Tower of Babylon at IDB.”
While
complex corporate pyramid schemed, with no transparency have been
recognized as detrimental to integrity of corporate regulation and
financial markets integrity, and while measures are drafted to level
such corporate schemed, the Tel Aviv District Court is in the
process of approving a uniquely convoluted corporate scheme as part
of Tycoon Dankner's efforts to keep control of his corporate empire
with no capital to support such control.
Today's
news should not be considered in the margins of the saga:
Deprivation of the bond-holders' rights for due process, and denial
of access to the court by the State of Israel' s Regulator of
Financial Markets in this case have been been core issues in this
case since its commencement:
*
Inspections of the court file revealed changes in the records that
are publicly accessible.
*
Inspection revealed no Notices of Appearance by any of the numerous
counsel who appear in the case.
*
Judge Eitan Orenstein was recently appointed Deputy Presiding Judge
of the Tel Aviv District Court, and who is likely to handle many of
the large corporate cases. Judge Orenstein was also named one of
the main suspects, together with Magistrate Hagai Brenner, Attorney
(retired judge) Sarah Frish, and the Clerk of the Court in running a
simulated process in the case of self-immolated, social protest
activist Moshe Silman.
Conduct
of Judge Eitan Orenstein in this matter is similar to that of his
predecessor Judge Varda AlSheikh:

Judge AlSheikh was caught falsifying her own court records, conduct
that should be deemed criminal. However, the Israeli justice system
refused to take any material actions against her.
It
should be recalled that one of the early bangs of the US financial
crisis was the January 8, 2013 publication by the NYT that
Countrywide, the US largest mortgage lender, filed fabricated papers
in the US bankruptcy court in Pennsylvania. Within hours, the
Countrywide share collapsed, and almost dragged the entire stock
market with it. Lack of trust in the justice system is a direct
cause for lack of trust in the financial markets.
Therefore,
the growing evidence of material escalation in corruption of the
courts and the legal profession in Israel in recent years, should be
seen as a major risk factor for the Israeli financial system. Even
now one can conclude that corruption of the courts and the legal
profession, from the debtors courts to the supreme court, is central
to socio-economic conditions in Israel today.
In
reviewing the Israeli courts, denial of access to court records
should be recognized as central cause for the corruption. Efforts
should be made to publish the entire IBD bankruptcy file –
Hermatic v IDB
(36681-04-13). References
6-8 below show most of the papers in the file by May 2, 2013.

אולם חדשות היום אינן בשולי הסאגה כלל: שלילת זכותם של מחזיקי אגרות החוב - ציבור החוסכים- למשפט הוגן, ושלילת גישתו לתביעה של המפקח על שוק ההון באוצר היו במרכז תיק זה מראשיתו:
* בדיקות קודמת של תיק אי. די. בי, העלתה הבדלים ניכרים בכתבים המוצגים לציבור על ידי בית המשפט. בבדיקה קודמת לא נמצאו ייפויי כוח לאף אחד מעורכי הדין הרבים שהופיעו בתיק זה.
* השופט איתן אורנשטיין מונה לאחרונה כסגן נשיא בית המשפט המחוזי ת"א, וככל הנראה זה שיטפל בתיקים תאגידיים גדולים. יחד עם זאת, כרשם, איתן אורנשטיין הוא אחד מן החשודים העיקריים, יחד עם הרשם חגי ברנר, עו"ד (שופטת בדימוס) שרה פריש, ומזכירי בית המשפט, בתלונה שהוגשה ליועץ המשפטי לממשלה, לגבי ניהול הליכים למראית עין בתיקים הקשורים למשה סילמן, ז"ל.
והתנהלותו של השופט איתן אורנשטיין בעניין זה גם דומה להתנהלותה של קודמתו בתפקיד - ורדה אלשייך:
* השופטת (בדימוס) ורדה אלשייך נתפסה משבשת את כתבי בית המשפט, שמבחינה קרימינולוגית תיחשב להתנהלות פלילית חמורה, אך מערכת המשפט בישראל סירבה לפעול כנגדה בצורה מהותית.
יש לזכור שאחד ממפצי הפתיחה של המשבר הבנקאי בארה"ב היה הפרסום בניו יורק טיימס ב-8 לינואר, 2008, שקאונטריוויד, הבנק הגדול למשכנתאות, הגיש מסמכים מפוברקים בבית המשפט הפדרלי בפנסילבניה במשפט בעניין משכנתא על ביתה של מועמדת לפינוי. תוך מספר שעות קרסה מניית החברה וכמעט שהתמוטטה הבורסה. חוסר אימון ביושרת המחלקות המשפטיות בבנקים, ובמקביל ביושרת בתי המשפט, הם גורמים ישירים לחוסר אימון בשוק ההון.
לפיכך, יש לראות את הראיות המצטברות לגבי עלייה מהותית בשחיתות בתי המשפט ומקצוע עריכת הדין בשנים האחרונות, כגורם סיכון מרכזי ליצבות שוק ההון בישראל. כבר עתה ניתן לומר ששחיתות בתי המשפט ומקצוע עריכת הדין, מן ההוצאה לפועל ועד לבית המשפט העליון, הם גורמים מרכזיים במצב החברתי-כלכלי בישראל היום.
מניעת גישת הציבור לכתבים, אפילו בתיקים אזרחיים בעלי חשיבות ציבורית, כגון תיק "פירוק אי.די.בי." היא בבסיסו של המצב בבתי המשפט בישראל. יש לפעול לפרסום כלל הכתבים בתיק - הרמטיק נ אי.די.בי. (36681-04-13) [בקישורים 6-8 להלן מרבית הכתבים מיום פתיחת התיק ועד ה-2 במאי].
