OccupyTLV, May 8 - Joseph Zernik, PhD, of Human Rights Alert (NGO) filed in the Supreme Court a Repeat Request to Inspect the Roman Zadorov court file.
The original Request to Inspect the Zadorov court file was filed on March 23, 2015. [1]  The Request was denied, following a process, where the parties' responses were not served on the Requester. [2] Zadorov did not object to the inspection, the State of Israel did... The Requester was given no opportunity to reply on the parties' responses, and was not served with the decision either. Following a request for a signed and certified copy of the April 27, 2015 Decision - denying the Request to Inspect - a perverted record was recived from the Supreme Court. [3]
The April 27, 2015 Decision by Justices Danziger, Amit, and Zilbertal in part says that the State of Israel objects to the inspection, since the Request to Inspect "is unclear, and the court file includes sensitive materials, hearings behind closed doors, and materials, where inspection may violate privacy rights".
The conduct of criminal hearings behind closed doors, combined with the denial of public access to the records may be deemed a serious violation of Human Rights.
Zadorov was convicted on the 2006 murder of a young teenager, Tair Rada, which took place in her school in the Katzarin. Serious concerns have been raised regarding integrity of the police investigation, the prosecution, and the court process in this case.  The case generated unprecedented public support for the accused.
The Request to Inspect the Roman Zadorov court file in the Supreme Court was filed as part of a study of access to court files in the State of Israel, following major changes in administration of the courts over the past decade.  While the Israeli courts repeatedly declared that public access to court files is a "basic principle of a democratic regime", experience so far indicates that the courts place major hurdles on public access to court files.  The denial of access is particularly noticeable in cases related to corruption of government agencies.

Public access to court records is known for centuries as the fundamental way to safeguard the integrity of the courts, and absent public access to court records it is impossible to maintain the integrity of the courts.

מאהל המחאה ת"א, 8 למאי - דר' יוסף צרניק (Human Rights Alert - NGO) הגיש בבית המשפט העליון בקשה חוזרת לעיון בתיק רומן זדורוב.
בקשה ראשונה לעיון בתיק זדורוב הוגשה ביום 23 למרץ, 2015. [1] הבקשה נדחתה לאחר הליך בו לא הומצאו תשובות הצדדים (הסנגוריה לא התנגדה, הפרקליטות התנגדה) למבקש העיון, לא נתנה למבקש הזדמנות להגיב על תשובות הצדדים, וכן לא הומצאה לו החלטת בית המשפט על דחיית הבקשה לעיון... [2]  ובתגובה על בקשה לקבלת העתק ההחלטה חתום ומאומת כדין, התקבל כתב החלטה משובש מבית המשפט העליון. [3]
ההחלטה מיום 27 לאפריל, 2015, מאת  השופטים דנציגר, עמית וזילברטל אומרת בחלקה, שהמדינה מתנגדת בטענה שהבקשה "אינה בהירה, והתיק כולל חמרים רגישים, דיונים שנערכו בדלתיים סגורות, וחומרים שהעיון בהם עלול לפגוע בצנעת הפרט". 
רומן זדורוב הורשע ברצח הילדה תאיר זאדה, שהתרחש בבית הספר בו למדה בקצרין בשנת 2006.  חששות רבים הועלו לגבי תקינות חקירת המשטרה, התנהלות התביעה, וההליכים בבתי המשפט בתיק זה, שגרר התעניינות ציבורית ותקשורתית חסרת תקדים.

הבקשה לעיון בתיק זדורוב הוגשה כחלק מסקר על גישת הציבור לעיון בתיקים בבתי המשפט בישראל, לאחר המהפך בהנהלת בתי המשפט בעשור האחרון.  בתי המשפט בישראל הכריזו שוב ושוב שזכות גישת הציבור לעיון בתיקים היא "עקרון בסיסי במשטר דמוקרטי".  אולם הסקר מראה שבפועל, בתי המשפט מקשים או מסרבים לאפשר את הגישה לעיון בתיקים.  מצב זה בולט במיוחד בתיקים הנוגעים לשחיתות רשויות השלטון.  גישת הציבור לעיון בתיקי בתי המשפט מוכרת מזה מאות שנים כאמצעי הבסיסי לשמירה על יושרת בתי המשפט, וללא גישה לעיון בתיקי בתי המשפט בלתי אפשרי לשמור על יושרת בתי המשפט.

4. Purpose and Justification for the Inspection
Instant Request is filed pursuant to the Regulations of the Courts, – Inspection of Court Files (2003) and Supreme Court decision in Association for Civil Rights in Israel v Minister of Justice et al ( 5917/97):
a) The records, inspection of which is requested herein, are public court records, and instant court file is not sealed.
b) The previous Request to Inspect in instant court file was denied, based on objection by State of Israel, apparently pursuant to the following claims (State of Israel Response has not been served on the Requester to this date):
1. The Requester did not sufficiently clarify the nature of his research, and how the materials in instant court file advance such research.
2. Instant court file includes sensitive materials, hearings which were conducted behind closed doors, and materials, inspection of which may undermine the right for privacy.
3. Permitting inspection in instant court file by the Requester may require sorting the materials that should and should not be provided for inspection.
4. Instant court file is pending before the Court.
c) Relative to objection b)1., above – the previous Request to Inspect provided the following justification:
The Requester has been engaged for years in academic research regarding IT systems of the Israeli and US courts, and administration of public access to court records. His research on such subjects has been published and presented in international academic conferences in the relevant fields, subject to anonymous, international peer-review. His reports on such subjects have also been incorporated into UN Human Rights Council Reports pertaining to the United States (2010) and Israel (2013), following the Council's Professional Staff review.
d) Relative to objection b)1., above – instant Repeat Request to Inspect adds the following justification:
In part, the purpose of my study is to test the limits of the public's right to access court records and the requirement for justification of requests to inspect court records in the State of Israel in the wake of the 2009 Judgment in Association for Civil Rights in Israel et al v Minister of Justice et al (5917/97). The Judgment says in part:
The principle of public hearing is a fundamental principle of any democratic regime. It holds a constitutional status, superior to regular acts in our legal system, and there is no dispute regarding its importance and centrality...
The right to access court records to inspect and to copy and to publish their content is derived from Basic Law: The Judicature, Article 3, which provides the principle of public hearing, and from the rule, applicable to any public authority, which holds authority by law, according to which, in the absence of statutory provisions to the contrary, its records shall be open and visible...”. Judgment of the Israeli Supreme Court 4825/97 Gahel v Tax Assessment Officer (2001).”
Regarding the requirement for justification by the Filer of Request to Inspect versus the burden of convincing on a party opposing the inspection, the Judgment in the Association's petition says:
The opening position is that the inspection should be granted, and given such opening position, the party, who opposes the inspection, carries the burden of convincing that it should not be permitted...
The Filer of Request to Inspect needs to disclose the essence of his objective in the inspection... The burden is not on the Filer of the Request to Inspect, but on the party opposing the inspection. Under such circumstances, the requirement for justification in the Regulations – which, as stated, is minute, and unlimited in its causes – creates no burden of convincing on the Filer of the Request to Inspect... The infringement on the public's right to access court records to inspect and to copy – if any – resulting from the requirement for justification, is marginal and small, and in no case amounts to infringement, which requires examination of the Regulations under Constitutional standards...
The weight of the public's right to access court records to inspect and to copy by a person, who is driven by mere prurience, is inferior to the weight of the right of a person, who requests to inspect and to copy for the purpose of study or research.
e) Relative to objection b)2., above:
In instant Request, inspection of the evidence material is excluded. The evidence material is likely to be the more sensitive part of instant court file. The Requester asks to inspect only the records of requests and responses by the parties, as filed in the various appeals in the Supreme Court. Likewise, the Requester excludes from instant Request the protocols of any hearings, which were conducted behind closed doors.
f) Relative to objection b)3., above:
Since the Requester excluded from instant Repeat Request the evidence material, the issue of sorting the materials was substantially simplified.
g) Relative to objection b)34., above:
The right for fair, public hearing is one of the fundamental Human Rights, particularly in criminal prosecution. The claim that the Request to Inspect should be postponed while the case is pending, appears to restrict the principle of public hearing to its application only in retrospect, but not during of the litigation. It is doubted that a reasonable person would find such argument convincing. On the contrary, any reasonable person would most likely find that postponing the right to inspect until after the judicial process is completed as voiding the principle of public hearing from its foundation.
h) Instant court file holds the highest public policy significance, since it raised and raises numerous concerns among the public at large and experts:
Regarding instant court file, an expert on criminal law wrote: “Conduct of the State Prosecution is scary”.
  • Regarding instant court file, another expert on criminal law wrote: “There is no scientific evidence tying the suspect to the crime scene, there is no motive for the crime. The suspect denied his guilt during most of the investigation stages and all along his trial. When he confessed, he did not lead the investigators to any evidence at all...”. “The Verdict is not convincing that guilt was proven beyond any reasonable doubt.” “The new Verdict in the matter of Roman Zadorov raises numerous concerns, on top of concerns that were raised by the original Verdict in this affair. Zadorov's guilt was not proven beyond a reasonable doubt”.
  • Interest of the public at large in instant court file is unprecedented. Tens of thousands of citizens are listed in groups, which support the innocence of the accused and call for justice for the accused.
  • To the Requester's best knowledge and belief, citizens who examined the evidence material that was accessible to them, also filed criminal complaints with the Ministry of Justice and/or the Attorney General against members of the investigation team for perverting and/or falsifying evidence, and against members of the prosecution team for deliberately misleading the Court.
i) The Judgment in the Association's petition also repeats the petitioners' arguments regarding the importance of the right to access court records relative to public trust in government authorities:
The importance of this principle is in generating public trust in the public authorities in general, and in the courts in particular, since it contributes to generating the appearance of the process of justice in a manner that promotes such trust.
Given the above, relative to concerns by the public at large and criminal law experts regarding instant court file, generating public trust in public authorities and in the courts should be deemed of particular significance in instant court file.
j) A similar statement appears in the landmark ruling of the US Supreme Court, pertaining to the public's right to access court records to inspect and to copy, as one of the foundations of such right: to fulfill the citizen's desire 'to keep a watchful eye on the workings of public agencies'. [i]

ב) הבקשה הקודמת לעיון בתיק זה נדחתה משום התנגדות המדינה, ככל הנראה על פי הטענות, שעיקרן להלן (תשובת המדינה לא הומצאה למבקש עד יום זה):
  1. המבקש‬ לא הבהיר די הצורך את טיב המחקר שהוא עורך, וכיצד החומרים בתיק זה מקדמים אותו.
  2. התיק כולל חומרים רגישים, דיונים שנערכו בדלתיים סגורות, וחומרים שהעיון בהם עלול לפגוע בצנעת הפרט.
  3. העמדת התיק לעיונו של המבקש כרוכה בסיווג החומרים המותרים לעיון לבין אלו שלא ניתן לעיין בהם.
  4. התיק תלוי ועומד בבית המשפט.
    ג) לעניין ההתנגדות ב)1., לעיל - בבקשה הקודמת לעיון נתנה ההצדקה להלן:
המבקש עוסק מזה שנים במחקר אקדמי בנושא מערכות הכתבים האלקטרוניים של בתי המשפט בישראל ובארה"ב וניהול גישת הציבור לכתבים. מחקריו בנושא זה הוצגו ופורסמו בכנסים אקדמים בינלאומיים בתחומים המתאימים, בכפוף לבדיקת עמיתים בינלאומית אנונימית. דוחות שחיבר בנושאים אלה, נכללו בדוחות מועצת זכויות האדם של האו"ם על ארה"ב (2010) ועל ישראל (2013), בכפוף לבדיקה על ידי הצוות המקצועי של המועצה.
ד) לעניין ההתנגדות ב)1., לעיל - בבקשה חוזרת זאת אוסיף את ההצדקה להלן:
בחלקה, מטרת‬ מחקרי לבדוק את גדרי זכות העיון ואת גדרי חובת ההנמקה של המבקש לעיין בכתבי בתי המשפט בישראל בעקבות פסק הדין משנת 2009 בעתירת האגודה לזכויות האזרח ואח' נ שר המשפטים ואח' (5917/97). פסק דין זה אומר בין השאר:
עקרון פומביות הדיון הוא עקרון יסוד של כל משטר דמוקרטי. הוא בעל מעמד חוקתי על-חוקי בשיטתנו המשפטית, ועל חשיבותו ומרכזיותו אין חולק...
"הזכות לעיין במסמכי בית המשפט ואף הזכות לפרסם את תוכנם נגזרות מסעיף 3 לחוק יסוד: השפיטה, הקובע את עקרון פומביות הדיון, ומן הכלל החל על כל רשות ציבורית הממלאת תפקיד על-פי דין, ולפיו, בהעדר הוראה חקוקה הקובעת אחרת, מסמכים שברשותה צריכים להיות גלויים ופתוחים...". פסק הדין בע"א 4825/97 גהל נ' פקיד השומה למפעלים גדולים, פ"ד נה(2) 433, 437 (2001)
וכן אומר פסק הדין בעתירת האגודה לגבי חובת ההנמקה של מבקש העיון לעומת נטל השכנוע על המתנגד לעיון:
נקודת המוצא הינה כי יש להתיר את העיון, ובהתחשב בנקודת מוצא זו, על בעל הדין המתנגד לעיון הנטל לשכנע כי אין להתירו...
על מבקש העיון לגלות בתמצית את מטרת העיון... הנטל הוא לא על מבקש העיון כי אם על המתנגד לו. במצב דברים זה, אין בדרישת ההנמקה הקבועה בתקנות - שהינה כאמור דרישה מזערית אשר אינה מוגבלת בעילותיה - משום הטלת נטל השכנוע להתרת העיון בתיק על מבקש העיון... הפגיעה בזכות העיון - אם נגרמת - כתוצאה מדרישת ההנמקה הינה פגיעה שולית וקטנה ביותר, אשר בכל מקרה אינה עולה כדי הפגיעה המחייבת את בחינת התקנות במשקפי הבחינה החוקתית...
משקלה של זכות העיון של מי שמבקש לעיין בתיק מתוך סקרנות גרידא פחוּת ממשקל זכותו של מי שמבקש לעיין בתיק לצורך לימוד או מחקר.
ה) לעניין ההתנגדות ב)2., לעיל:
מבקש העיון הוציא מכלל בקשה חוזרת זאת את העיון בחומר הראיות, שהוא מן הסתם החלק הרגיש בתיק זה, ומבקש לעיין אך ורק בכתבי הבקשות והתשובות שהוגשו על ידי הצדדים בערעורים בבית המשפט העליון. כמו מן הוציא מבקש העיון מכלל בקשה זאת את העיון בפרוטוקולים של דיונים שנערכו בדלתיים סגורות.
ו) לעניין ההתנגדות ב)3., לעיל:
מכיוון שמבקש העיון הוציא מכלל בקשה חוזרת זאת את העיון בחומר הראיות, מפשטת הבקשה החוזרת את עניין סיווגו של החומר בצורה מהותית.
ז) לעניין ההתנגדות ב)4., לעיל:
הזכות לשימוע הוגן ופומבי היא מזכויות האדם הבסיסיות, בפרט בהליכים פליליים. הטענה שיש לדחות את הבקשה לעיון בתיק בזמן שהתיק תלוי ועומד לפני בית המשפט נראית כמצמצמת את עקרון פומביות השימוע לכדי הפעלתו רק בדיעבד, אך לא במשך השימוע. ספק אם אדם בר דעת ימצא טיעון זה משכנע. נהפוך הוא, כל אדם בר דעת קרוב לוודאי ימצא את דחיית זכות העיון עד לאחר תום ההליך המשפטי כמעקרת את עקרון פומביות השימוע מיסודו.
ח) לתיק זה חשיבות ציבורית מן המעלה הגבוהה ביותר, שכן תיק זה עורר ומעורר תהיות רבות בקרב הציבור ובקרב מומחים:
  • לגבי התנהלות תיק זה כתב מומחה למשפט פלילי: "ההתנהלות של הפרקליטות בתיק זדורוב מפחידה".
  • לגבי התנהלות תיק זה כתב מומחה אחר למשפט פלילי: "אין ראיה מדעית הקושרת את החשוד לזירת הפשע, אין מניע לרצח. החשוד הכחיש את אשמתו ברוב שלבי חקירתו ולאורך שנות משפטו. כשהודה, לא הוביל את החוקרים לראיה כלשהי"... ”פסק הדין אינו משכנע שהאשמה הוכחה מעבר לספק סביר.” “פסק הדין החדש בעניינו של רומן זדורוב מעורר תמיהות רבות, נוסף על התמיהות שעורר פסק הדין המקורי בפרשה. אשמתו של זדורוב אינה מוכחת מעל לכל ספק סביר.”
  • העניין הציבורי בתיק זה חסר תקדים. עשרות אלפי אזרחים מן השורה רשומים בקבוצות התומכות בחפותו של הנאשם ובעשיית צדק לנאשם.
  • למיטב ידיעתו ואמונתו של מבקש העיון, אזרחים מן השורה, שבדקו את החומר הנגיש לציבור, גם הגישו תלונות פליליות למשרד המשפטים ו/או ליועץ המשפטי לממשלה נגד אנשי צוות החקירה על שיבוש ו/או בדיית ראיות, ונגד אנשי הפרקליטות על הטעייה מכוונת של בית המשפט.
ט) פסק הדין בעתירת האגודה גם חוזר על טיעוני העותרים לגבי חשיבות זכות העיון לגבי אמון הציבור ברשויות השלטון ובבתי המשפט:
חשיבותו של עקרון זה ביצירת אמון הציבור ברשויות הציבור בכלל ובבתי המשפט בפרט, שכן הוא תורם ליצירתה של מראית פני הליך עשיית הצדק באופן המקדם אמון זה.
לאור האמור לעיל לגבי תהיות הציבור ומומחים למשפט פלילי לגבי תיק זה, יש לראות ביצירת אמון הציבור ברשויות הציבור ובבתי המשפט עניין משמעותי ביותר בתיק זה.
י) בדומה, מוצאת פסיקה בעלת חשיבות היסטורית של בית המשפט העליון של ארה"ב את הבסיס לזכות העיון, בין השאר, בצורך לספק את רצונו של אדם "להחזיק עין מפקחת על פעולותיהן של הרשויות הציבוריות.” [1]
